This is a Terms of Use — Strike Jiu-Jitsu

Effective Date: October 10, 2025

Welcome to Strike Jiu-Jitsu (“we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of our facilities, classes, programs, events, websites, mobile services, and any related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Notice: Brazilian Jiu-Jitsu (BJJ) is a contact sport that involves inherent risk. Please read the Assumption of Risk & Waiver section carefully.

1) Eligibility & Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to enroll without a parent/guardian.

Minors may participate only with the express consent of a parent or legal guardian, who must sign all required forms and will be responsible for the minor’s compliance with these Terms.

You agree to provide accurate, current, and complete information during sign-up and to keep it updated.

2) Health, Medical Clearance & Safety

You represent that you are physically fit to participate in BJJ and related training and have no medical condition that would make participation unsafe.

We may, at our discretion, require a physician’s clearance.

You must immediately inform instructors of any injury, condition, or limitation and follow all safety instructions, including tapping early and respecting training partners.

3) Assumption of Risk & Waiver of Liability

Inherent Risks: BJJ involves strenuous physical activity and close contact, which may result in injuries including but not limited to sprains, strains, dislocations, fractures, concussions, cuts, bruises, infections (including skin infections), and other serious injuries.

Voluntary Participation: You voluntarily assume all risks associated with participation, including risks arising from the negligence of other participants.

Release: To the fullest extent permitted by law, you release and discharge Strike Jiu-Jitsu, its owners, managers, instructors, contractors, staff, and agents from any and all claims, demands, liabilities, damages, costs, or expenses arising out of or related to your participation in the Services, except where prohibited by law.

Indemnification: You agree to indemnify and hold harmless Strike Jiu-Jitsu from any claims arising from your actions or violations of these Terms.

4) Conduct, Etiquette & Prohibited Behavior

Follow instructor directions at all times; failure to do so may result in removal from class.

Maintain good hygiene, wear appropriate attire, keep fingernails/toenails trimmed, and remove jewelry/piercings that could cause injury.

No harassment, bullying, discrimination, or unsafe conduct. Respect training partners and tap early/tap often.

No drugs, alcohol, or performance-enhancing substances. If we suspect impairment, we may refuse participation.

We may suspend or terminate access to the Services for violations of these rules, with or without refund as permitted by our policies below.

5) Memberships, Billing & Cancellations

Plans & Fees: Membership options (e.g., month-to-month, contracts, class packs, drop-ins) and pricing are posted at the time of purchase and may change prospectively.

Auto-Renew: Unless otherwise stated, memberships auto-renew each billing cycle. You authorize recurring charges to your payment method on file.

Cancellations: Cancellation requirements (e.g., written notice period) are specified at purchase. If not stated, a 30-day written notice before the next billing date is required.

Holds/Freezes: Freeze options, if any, are subject to eligibility and fees as posted.

Refunds: All sales are final unless a posted policy or applicable law provides otherwise. Unused classes in a pack typically expire after the stated period.

Failed Payments: You are responsible for maintaining a valid payment method. Late or failed payments may incur fees and/or suspension.

6) Class Reservations, No-Shows & Late Arrivals

Booking: Some classes require advance reservations.

No-Show/Late Cancel Fees: We may charge a fee for no-shows or cancellations within the late-cancel window.

Punctuality: Arrive on time and complete warm-ups. Late arrivals may be denied entry for safety reasons.

Schedule Changes: Class times, instructors, and programming may change. We may cancel or reschedule classes at our discretion.

7) Facility Rules & Personal Property

Use the premises, mats, and equipment only as instructed.

Keep valuables secure. Strike Jiu-Jitsu is not responsible for lost, stolen, or damaged personal items.

We reserve the right to close the facility temporarily for maintenance, holidays, events, or emergencies.

8) Media Release

By entering the facility or participating in events, you grant Strike Jiu-Jitsu the right to capture, use, reproduce, and publish photos/video/audio of you for training, documentation, and promotional purposes in any media now known or later developed, without additional compensation. If you have concerns, please notify us in writing; we will make reasonable efforts to accommodate where practicable.

9) Communications & Privacy

Electronic Communications: By providing your contact information, you consent to receive communications (e.g., emails, SMS) regarding schedules, billing, promotions, and important notices. Message and data rates may apply. You may opt out per message instructions; transactional and safety notices may still be sent.

Privacy: We handle personal information in accordance with our privacy practices. Do not share others’ personal information without consent.

10) Online Services & Intellectual Property

Content Ownership: Our websites, apps, training materials, logos, and content are owned or licensed by Strike Jiu-Jitsu and protected by intellectual property laws.

Limited License: We grant you a limited, non-transferable, revocable license to access and use our online Services for personal, non-commercial use.

Restrictions: You may not copy, modify, distribute, reverse engineer, or exploit our content or software.

User Content: If you submit reviews, comments, or other content, you grant us a worldwide, royalty-free license to use, reproduce, and display such content in connection with the Services.

11) Third-Party Links & Services

Our Services may link to third-party sites or integrate with third-party tools. We are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

12) Disclaimers

No Warranty: The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement.

No Medical Advice: Training and information provided by Strike Jiu-Jitsu are not medical advice. Consult a qualified healthcare professional before starting any new exercise program.

13) Limitation of Liability

To the fullest extent permitted by law, Strike Jiu-Jitsu will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or data, arising from or related to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claim will not exceed the amount you paid to Strike Jiu-Jitsu in the six (6) months preceding the event giving rise to the claim.

14) Dispute Resolution, Governing Law & Venue

Good-Faith Resolution: Contact us first to attempt a good-faith resolution.

Arbitration (Optional—remove if not desired): Except for small-claims matters or injunctive relief, disputes shall be resolved by binding arbitration on an individual basis. Class actions and jury trials are waived to the extent permitted by law. The arbitration provider, rules, seat, and procedures will be designated by Strike Jiu-Jitsu or mutually agreed upon.

Governing Law: These Terms are governed by the laws of the state/province where our primary facility is located, without regard to conflicts of law.

Venue: Exclusive venue for any permitted court action will be the state and federal courts located in that jurisdiction.

15) Suspension & Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms or for behavior that jeopardizes safety or disrupts operations. You remain responsible for any outstanding fees.

16) Changes to Terms

We may update these Terms from time to time. Changes take effect upon posting or notice to you. Continued use after changes means you accept the updated Terms.

17) Severability & Entire Agreement

If any part of these Terms is found unenforceable, the remainder will remain in effect. These Terms, together with any posted policies (e.g., membership, cancellation, privacy), constitute the entire agreement between you and Strike Jiu-Jitsu regarding the Services and supersede prior understandings.
